Terms & Conditions

These Terms and Conditions govern your use of the KayaFlix. By accessing or using KayaFlix, you agree to be bound by these Terms. If you do not agree to the Terms, you may not use the app.

• Eligibility. KayaFlix is restricted to individuals at least 18 years old. By accessing it, you represent that you are an adult and have the legal capacity to enter this agreement.
• Account creation.You're responsible for the confidentiality of your account credentials and for any activity under your account.
• Content access. Availability may vary and content may be added or removed at any time.
• Prohibited conduct. You agree not to use the App for unlawful purposes, transmit malicious code, interfere with operation, hack other accounts, or violate applicable laws.

All content available on or through KayaFlix videos, audio, text, graphics, interfaces, logos, trademarks, service marks, and software—is the exclusive property of Cine Popular Entertainment Inc. or its licensors and is protected by Philippine and international IP law.

• Copyright. Limited, non-exclusive, non-transferable license for personal, non-commercial use only.
• Trademarks. No license is granted to use any KayaFlix marks without prior written consent.
• Enforcement. We reserve all remedies for infringement under R.A. 8293 and other applicable laws.

Our App uses Digital Rights Management (DRM) and Encrypted Media Extensions (EME) to protect content. By using the App, you acknowledge and agree to the following:

• Protected content — some content is DRM-protected.
• Device & browser compatibility — DRM-protected content may be limited to compatible devices, OSes, and browsers that support EME.
• Third-party providers — DRM/EME involves providers such as EZDRM.
• No circumvention — you agree not to bypass, modify, or defeat DRM/EME mechanisms.
• Termination of access — unauthorized use will result in suspension or permanent termination, and may lead to civil or criminal liability.

• Third-party content — some videos may come from partner creators.
• Geographic restrictions may apply to content availability.

• Plans. KayaFlix may offer plans that provide access to features or content.
• Payment. You agree to pay all applicable fees for any plans you purchase.
• Cancellation. Cancel anytime via account settings; prior charges are non-refundable.

PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED OR ERROR-FREE.

TO THE FULLEST EXTENT PERMITTED BY LAW, CINE POPULAR ENTERTAINMENT INC. AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF YOUR USE OF — OR INABILITY TO USE — THE APP.

You agree to indemnify, defend, and hold harmless Cine Popular Entertainment Inc. and its affiliates from claims arising out of your use of the App, breach of these Terms, or violation of applicable laws. This obligation survives termination.

We may update these Terms from time to time and will notify you of material changes by posting the updated Terms in the App or by email/in-app notifications.

These Terms shall be governed by and construed in accordance with the laws of the Republic of the Philippines, with exclusive jurisdiction in the proper courts of Quezon City, Metro Manila.

Disputes shall first be resolved amicably. Unresolved disputes (after 15 days) will be referred to a mutually-appointed neutral mediator in Quezon City under R.A. 9285 (Alternative Dispute Resolution Act of 2004) and its implementing rules.
